Mediation (and Mediation/Arbitration) is a fast-growing process in family law, offering an arguably superior method for resolving family disputes. In family mediation, a trained mediator leads you through an interest-based process, that can result in agreements between the parties that meet a family's needs, better than a judge might order, in a costly and high conflict court proceeding.
While you may not relish the idea of sitting down at a table with your ex-partner to discuss an agreement, the positives of doing so are numerous, including a most-often quicker result, at much less financial and personal cost, where you are actively involved in crafting solutions that will work for your family, rather than having a court-imposed solution. Mediation can lead to both better agreements and better long-term communication between parties, which is of the utmost benefit to your children.
A mediator cannot give either party legal advice, and will not take one person's side over the other; their job is not to decide anything, but to assist the parties in communicating and resolving their disputes, without the court's intervention.
If mediation is not successful in resulting in a full agreement, it can often lead to agreement on some issues, narrowing the issues to be addressed in litigation, or it can lead to interim (temporary) solutions that can save the parties thousands of dollars in avoiding court applications.
